Insurance

CPW attorneys have represented insurance carriers in hundreds of lawsuits in state and federal courts. Our work ranges from providing advice on small property coverage disputes to litigating complex toxic tort coverage cases. We have tried many insurance cases to jury verdict, and have argued frequently before the appellate courts, including several appearances before the California Supreme Court. We handle cases that involve both first-party insurance (property, business interruption, life, health, disability, auto, inland marine), and third-party insurance (CGL, professional liability, errors and omissions, and directors and officers).

We defend carriers sued in coverage and bad faith litigation, policyholders sued by third parties, agents sued for misrepresentation and other misconduct, and insurance companies sued by other carriers for contribution and indemnity. We are often hired to provide opinions concerning coverage, to give recommendations regarding the handling of claims, and to advise on policy drafting issues. We lecture widely in the insurance field – our presentations are addressed to both attorneys and industry professionals – and we have authored or co-authored many articles and treatises in this area.

  • Defended a major insurer in a jury trial of coverage and bad faith claims concerning a failed retaining wall and a boundary dispute.
  • Represented a carrier in multi-million dollar coverage action involving contamination of a Southern California water supply by an oil company.
  • Represented a carrier sued for bad faith for failing to provide coverage for damage caused by poria incrassata mold.
  • Represented a life insurer in a case involving murder for insurance profit.
