Alternative Dispute Resolution

CPW takes alternative dispute resolution seriously. Our successful representation of clients in mediation, arbitration and other alternative forums derives in large part from the substantial work that we perform as private mediators, arbitrators, and neutral appointees for the state and federal courts. Nationally-recognized plaintiff and defense firms have selected CPW attorneys to mediate disputes of all kinds, including insurance coverage and bad faith, commercial contract, and employment matters.

Federal and state courts regularly appoint CPW attorneys to serve as special masters in discovery disputes, special prosecutors, and pro tem judges. CPW's commitment to alternative dispute resolution is reflected in our volunteer work. We have served as mediators, arbitration panelists and neutral evaluators for the San Francisco Superior Court, the United States District Court for the Northern District of California, the San Francisco Bar Association, and Lawyers for the Arts.

Representative Cases

  • Mediated a bad faith claim involving a prominent disability insurer based on claims that a dentist was unable to work after a serious injury.
  • Appointed by a federal judge to arbitrate a complex construction case involving charges of professional negligence against an architect/engineer.
  • Mediated a multi-party dispute involving a stock transfer agent and a prominent Silicon Valley high-tech firm.
  • Appointed by the San Francisco Superior Court to serve as a special master to resolve and oversee the break-up and division of assets and liabilities of a law firm.
  • Appointed by a federal judge to investigate charges of misconduct pertaining to class action settlements.
  • Mediated a claim that a major auto dealership had violated California’s lemon laws and statutory provisions pertaining to Spanish translations of purchase agreements.
