CPW attorneys represent many companies in a wide variety of cases alleging liability arising from the use of their products. Manufacturers and distributors regularly call on us to defend claims of property damage, bodily injury, disability, and consequential business and other financial loss. Many of these cases have developed out of our work in other practice areas, particularly our real estate and construction practice. The firm also handles products liability insurance coverage disputes for both insured businesses and insurers.

Representative Cases

  • Defended a crane manufacturer against a dredging and dock construction company that alleged design defects, misrepresentation and breach of warranty in connection with the sale of a dredging crane.
  • Defended a chemical disinfectant manufacturer in an action by a nursing aide who alleged that she developed a respiratory disease from exposure to the disinfectant and the failure of the manufacturer to warn of potential danger.
  • Defended a pipe manufacturer in an action brought by a municipal utility district that alleged that defective pipe supplied to a water system resulted in property damage.
  • Defended a waste-hauling equipment manufacturer in an action for personal injury arising from an allegedly defective loading mechanism.
  • Defended a valve manufacturer in an action alleging that a worker who had used the valves had contracted a cancer caused by exposure to asbestos.
  • Defended a plumbing supplier in an action claiming extensive property damage and business loss to a hotel due to allegedly defective drain line fittings.
  • Defended rebuilder of allegedly defective shaft assemblies used in lumber mill.
